Nintendo has won a legal battle against Dstorage, a filesharing website operator, over piracy. In a statement, Nintendo announced that the Paris Court of Appeals has ruled that Dstorage failed to remove or block access to pirated copies of Nintendo games distributed via its website 1fichier.com, making the company responsible for the infringement.
Nintendo had previously requested that Dstorage remove any unauthorised Nintendo games on its site, but Dstorage failed to comply. As a result, Nintendo took legal action, and the Paris Judicial Court ruled in their favour in May 2021. The Court of Appeals has now upheld the ruling and ordered Dstorage to pay €442,750 to Nintendo in compensation, along with €25,000 to cover legal fees. Dstorage may choose to appeal the decision.
Announcing its victory, the company wrote: "Nintendo is pleased with the decision of the Paris Court of Appeals, as it again sends a clear message that in refusing to remove or withdraw access to unauthorised copies of video games despite prior notification, sharehosting services such as Dstorage (1fichier) are liable under French law and must remove or block access to such content and may be liable to pay compensation to those rights holders whose intellectual property rights have been infringed."
